1. Preambule

1.1 The following Terms of Use (hereinafter referred to as the “TOU”) regulate the access and usage of the this site (“Site”) as well as any services provided by Fundozer (“Services”) and are entered into by and between the owner and operator of this Site - Fundozer kft., with its registration address at 1054 Budapest, Honved u 8.1. em. 2, Hungary and VAT Number HU 29215863 (“Fundozer”, “We”, “Us” or “Our”) and any user accessing the Site or using Services whether individually or on behalf of another entity (“You” or “User”).

1.2 You agree that by accessing the Site and/or Services, You have read, understood, and agree to be bound by these TOU and our Privacy Policy available here: Privacy Policy.

1.3 If You do not agree with these TOU, then You are prohibited from using the Site and Services and You must discontinue use immediately. We recommend that You print a copy of these TOU for future reference.

1.4 We may make changes to these TOU at any time. The updated version of these TOU will be indicated by an updated “Last Updated” date and the updated version will be effective as soon as it is accessible. You are responsible for reviewing these TOU to stay informed of updates. Your continued use of the Site/Services represents that You have accepted such changes.

1.5 The Site is intended for users who are at least 18 years old. If You are under the age of 18, You are not permitted to use the Site or use the Services without parental permission.

1.6 The TOU shall remain in full force and effect during Your entire usage of the Site and/or Services. You may terminate Your participation at any time by ceasing to use the Site and Services. Fundozer may, it its sole discretion, terminate or suspend use of the Site or Services at any time for any or no reason without prior notice to You and without accruing any liability.

2. Site / Services

2.1 Subject to the TOU, Fundozer grants You a limited, non-exclusive and non-transferable right to access the Site and use services that may be provided on the Site.

2.2 Any part of the Site and/or Services may be changed or made inaccessible by Fundozer for the purposes of commercial necessity, improvement of user experience or any other reason in Fundozer’s sole discretion.

2.3 As a user of this Site, You agree not to:

  • Systematically retrieve data or other content from the Site to a compile database or directory without written permission from us
  • Use the Site to advertise or sell goods and services
  • Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any content or enforce limitations on the use
  • Engage in unauthorized framing of or linking to the Site
  • Engage in any automated use of the Site, such as using scripts or using any data mining, robots, or similar data gathering and extraction tools
  • Interfere with, disrupt, or create an undue burden on the Site or the networks and services connected to the Site

3. Intellectual Property

3.1 You acknowledge and agree that all of our trademarks, logos, copyrights and all other intellectual property rights in all content and materials on the Site shall remain vested in Fundozer at all times, unless explicitly stated otherwise by Fundozer. In cases where materials or content on the Site are used under the license from a third party, such rights remain vested in the owners of such material or content. Unless explicitly stated otherwise, all content and materials within the Site are owned by Fundozer or used by Fundozer under authorization and are protected by all applicable trademark and copyright laws.

4. DMCA Notifications of Claims of Infringement

4.1 If You believe that Your work has been copied on the Site and/or Services in a way that constitutes copyright infringement, or Your intellectual property rights have been otherwise violated, please notify our agent for notice of claims of copyright or other intellectual property infringement ("Agent"), at legal@fundozer.com.

4.2 Please provide us with the following Notice:

  • Identify the material on the Site and/or Services that You claim is infringing, with enough detail so that we may locate it on the Site and/or Services;
  • A statement by You that You have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • A statement by You declaring under penalty of perjury that (1) the above information in Your Notice is accurate, and (2) that You are the owner of the copyright interest involved or that You are authorized to act on behalf of that owner;
  • Your address, telephone number, and email address; and
  • Your physical or electronic signature.

4.3 We will remove the infringing posting(s), subject to the procedures outlined in the Digital Millennium Copyright Act (DMCA).

5. Limitation of Liability

5.1 To the fullest extent permitted by the applicable law, Fundozer disclaims any and all liability in connection with the Site, whether under tort, contract, negligence, strict liability or other legal or equitable theory, including any special, indirect, incidental or consequential losses or damages of any kind arising out of the use or inability to use the Site, any part of the Site or any data on the Site, regardless whether such losses or damages are foreseeable or not.

5.2 To the fullest extent permitted by the applicable law, the total amount of liability of Fundozer shall be limited by 1000 USD.

5.3 To the fullest extent permitted by the applicable law, any claim arising out of or relating to the TOU and/or the Site must be brought no later than one calendar year after the occurrence of the event which gave rise to such claim.

5.4 You understand and agree that Your sole remedy against Fundozer in regards to the TOU and the Site is to cease usage of the Site.

5.5 Under applicable law certain limitations of liability may not be permitted in specific cases. In such cases, this section shall be amended to apply in the fullest possible manner, excluding only the specific case for which the limitation of liability is expressly forbidden by the applicable law.

6. Jurisdiction

6.1 These TOU shall be governed by and construed in accordance with the laws of Hungary, without regard to its choice of law provisions. You agree to submit to the exclusive jurisdiction of the courts of Budapest, Hungary.

6.2 You hereby expressly waive any right to trial by jury or to resolution of dispute via arbitration.

7. Other

7.1 Severability. If any provision of these TOU is held by a court of competent jurisdiction to be contrary to law, the provision shall be modified by the court and interpreted so as best to accomplish the objectives of the original provision to the fullest extent permitted by law, and the remaining provisions of these TOU shall remain in effect.

7.2 Communication. Any questions, concerns, or notices in regards to the Site or these TOU should be sent to Fundozer via the designated email legal@fundozer.com. By communicating with us electronically You acknowledge that such email communications are not considered confidential.
